1. Overview
PickleBuddies ("the Service," "we," "us," or "our") is a community website available at www.picklebuddies.com that helps users organize pickleball ladders, matches, and related activities. The Service is operated by W3llspring Studio LLC. By accessing or using the Service, you agree to these Terms of Service ("Terms").
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. You are responsible for ensuring your use complies with applicable laws.
3. Accounts & Security
You agree to provide accurate information and maintain the security of your login credentials. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts at our discretion.
4. Acceptable Use
You agree to use the Service only for lawful pickleball-related purposes. You may not:
- Use the Service for unauthorized commercial purposes
- Post false, misleading, defamatory, or unlawful content
- Harass, threaten, or abuse other users
- Attempt to disrupt or interfere with the Service
- Create accounts using false information
5. User Content
You retain ownership of content you submit. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, modify (for formatting purposes), and distribute such content solely to operate and improve the Service. You are solely responsible for your content.
6. Community & Match Disputes
The Service provides tools for organizing matches and tracking results. We do not verify match outcomes, mediate disputes, or guarantee fairness. Users are responsible for resolving disputes among themselves.
7. Assumption of Risk & Sports Disclaimer
Pickleball is a physical activity that carries inherent risks of injury. By participating in matches organized through the Service, you acknowledge that you do so voluntarily and assume all risks associated with such activities. W3llspring Studio LLC is not responsible for injuries, accidents, or damages occurring during matches or events. The Service is a coordination tool only and does not supervise in-person activities.
8. Donations & Future Paid Features
The Service may accept voluntary donations to support development and hosting costs. Donations are voluntary and non-refundable. If paid features are introduced in the future, additional terms may apply and fees will be disclosed. Payments may be processed by third-party providers, for which we are not responsible.
9. Intellectual Property
All platform content, software, design, branding, and functionality (excluding user-submitted content) are owned by W3llspring Studio LLC. You may not copy, reproduce, reverse engineer, or distribute any part of the Service without permission.
10. Third-Party Services
We may use third-party hosting, analytics, or payment providers. We are not responsible for third-party services or their policies.
11. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of user-submitted information. We do not guarantee uninterrupted or error-free operation.
12. Limitation of Liability
To the fullest extent permitted by law, W3llspring Studio LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the greater of $100 USD or the amount you paid to the Service in the past 12 months.
13. Indemnification
You agree to indemnify and hold harmless W3llspring Studio LLC from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your conduct toward other users.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
15. Dispute Resolution & Arbitration
Please read this section carefully. It affects your legal rights.
Before initiating any legal proceeding, you agree to first contact us at support@picklebuddies.com and attempt to resolve the dispute informally for at least 30 days.
If a dispute cannot be resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall take place in Hillsborough County, Florida, or virtually/telephonically at the discretion of the arbitrator. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.
You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding. You also waive any right to a jury trial.
Notwithstanding the foregoing, either party may bring an individual claim in small claims court in Hillsborough County, Florida, provided the claim qualifies and remains in that court.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. If for any reason a dispute proceeds in court rather than arbitration, exclusive jurisdiction and venue shall lie in the state or federal courts located in Hillsborough County, Florida.
If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect.
16. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including outages, natural disasters, or governmental actions.
17. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
